When Prison Misconduct Violates Civil Rights

With overcrowding and staffing issues in our prison system, it is not uncommon for the civil rights of prisoners to be violated. Prisoners forego some rights in prison, such as the right to privacy. In addition, their property may be seized if it constitutes contraband. However, a prisoner’s civil rights could be violated by:

  • Cruel and unusual punishment, including torture, abuse, inmate beating and the use of excessive force
  • Lack of adequate medical care or treatment and mental health services
  • Discrimination based on race, gender, age, religion or sexual orientation
  • Sexual harassment or assault

Whether an assault was perpetrated by a prison official or another inmate, the prison still has an obligation to take necessary precautions and provide security measures to keep inmates safe. Any failure to do so could result in negligence on behalf of the prison itself, which could also lead to a third-party lawsuit to hold the prison responsible for damages.
