When Sexual Assault Occurs In The Workplace

When Sexual Harassment Rises To The Level Of Sexual Assault

Every employee deserves to work in an environment that is free from sexual harassment, which is defined as a form of discrimination and includes:

  • Quid pro quo requests for sexual favors
  • Unwelcome sexual advances or conduct
  • Physical or verbal harassment of a sexual nature

Victims of sexual harassment are protected by federal and state laws, that prohibit discrimination based on sex. While sexual harassment is illegal, and victims have the right to file a civil lawsuit for damages, workplace sexual assault is potentially criminal. It is possible that sexual harassment in the workplace can equate to sexual assault.

Holding Employers Accountable

When employers fail to protect employees in the workplace, a victim of sexual assault in the workplace may also have a claim against their employer. An employer may be held accountable if:

  • The employer fails to address known instances of sexual harassment.
  • The company fails to investigate employee complaints.
  • The company’s hiring process fails to properly screen an employee or conduct a background check.
  • The attacker is in a position of power at the company.
  • The employer fails to provide proper sexual harassment and abuse education or training.
  • The company fails to provide adequate security during work hours.
